LIZENZBEDINGUNGEN
1. Ownership and License:
The creator of the digital asset retains all rights in the asset and grants Licensee a non-exclusive, non-transferable license to use the asset under the terms of this License Agreement.
2. Sale and redistribution:
Licensee may not sell, rent, loan, distribute, transfer, or otherwise distribute the Digital Asset without first obtaining the express written consent of the asset’s creator. Licensee may use the digital asset as part of a larger product made up of additional elements. Licensee may create products, such as flyers, t-shirt designs, and the like, that incorporate the digital asset as an integral part.
3. Use of the asset:
Licensee may only use the digital asset for personal or business use and may not use the asset for any unlawful purpose or in a manner that tarnishes the reputation of the asset’s creator.
4. Copyright and Trademarks:
Licensee acknowledges that the Digital Asset is protected by copyright and other intellectual property laws. Licensee may not make any changes to the Asset that infringe copyright or other proprietary rights.
5. Disclaimer:
The creator of the asset is only liable – except in the case of injury to life, limb or health or insofar as a legally mandatory no-fault liability (e.g. according to german ProdHaftG) or liability from a no-fault guarantee is provided – if essential contractual obligations (Cardinal obligations) are violated. Liability for indirect and unforeseeable damage or loss arising from the use of the digital asset or the digital product, including direct, indirect or consequential damage, is excluded in the case of simple negligence – except in the case of injury to life, limb or health .
6. Termination:
The digital asset creator may terminate this License Agreement at any time if Licensee breaches any of the terms of this Agreement. In case of termination, Licensee must immediately destroy the Digital Asset and all copies thereof.
7. Applicable law:
The place of jurisdiction for all disputes in connection with consumer transactions arising from this agreement is the Federal Republic of Germany. However, this regulation does not apply if mandatory provisions of the law of the country in which the consumer has his habitual residence grant him a more comprehensive protection that cannot be withdrawn.
8. EU Dispute Settlement:
The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/. It serves as a central contact point for the out-of-court settlement of disputes in connection with online purchases of goods or services between consumers and entrepreneurs within the European Union. The author is not willing or obliged to participate in dispute settlement proceedings before a consumer arbitration board.
